Disputes are as old as human interaction. From boundary conflicts in villages to multi-billion-dollar cross-border business disputes, the central question has always been: how do we resolve differences fairly, efficiently, and sustainably? For centuries, the courtroom has been the default answer. But today, we live in a world where time, cost, and relationships matter just as much as the outcome itself. This is where Alternative Dispute Resolution (ADR) comes in.
Why Clause & Cause?
The name reflects what ADR is all about. A clause in a contract can decide how a cause of action is resolved. Whether it’s arbitration, mediation, conciliation, or negotiation, the language we draft today can shape the disputes of tomorrow.
Clause & Cause is my attempt to create a space where law students, professionals, and enthusiasts can explore this fascinating field together. Handled by an ADR enthusiast (that’s me!) who is still navigating and learning, this blog is not about presenting a finished picture; it’s about sharing a journey of discovery, insight, and dialogue.
What to Expect Here
On Clause & Cause, you’ll find:
Case Notes – crisp summaries of landmark judgments on arbitration, mediation, and ADR.
Concept Explainers – making sense of terms like “seat vs. venue of arbitration” or “institutional vs. ad hoc arbitration”.
Drafting Insights – practical tips on how to craft effective dispute resolution clauses.
Opinion Pieces – reflections on reforms, trends, and the evolving role of ADR in India and globally.
Career & Learning Resources – guidance on ADR moots, internships, and opportunities for young lawyers.
Why ADR Matters Now
In India, with the passage of the Mediation Act, 2023 and continued emphasis on institutional arbitration, ADR is no longer a “side option”. It is becoming central to our justice delivery system. Globally too, international arbitration and mediation are shaping how businesses, governments, and communities manage conflict. For law students and professionals, understanding ADR is not just an academic exercise; it is a skillset for the future.
